Proposed EU libel law under fire

European publishers are objecting to a European Commission proposal,
known as Rome II, which would allow a claimant in defamation or privacy
cases to choose what country's law should apply. The EC solution is
intended to clarify which laws should apply to cross-border complaints.
However, the proposal could result in claims in any of the countries
where a publication is distributed. According to the UK's Periodical
Publishers Association, the best solution for the press would be to
apply the law of the place where the material is created. However,
according to Commission officials, this does not agree with the law in
any of the member states.
